1. Agreement to Terms

By accessing or using MailWand, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. "You" refers to the individual or entity using MailWand. "We", "us", and "MailWand" refer to the MailWand service and its operators.

2. Description of Service

MailWand is an AI-native email client that transforms high-volume inboxes into structured, adaptive workflows. It connects to your email accounts (Gmail and Outlook) via OAuth, automatically groups and classifies your messages, surfaces priorities, and uses a combination of code-based rules and AI to organize and extract structured data from them.

3. Account and Access

  • You must authenticate via Google or Microsoft OAuth to use MailWand.
  • You are responsible for maintaining the security of your account and connected email accounts.
  • You may link multiple email accounts (Gmail and Outlook) from your workspace settings.
  • You must not share your session or allow unauthorized access to your MailWand account.

4. Permitted Use

You agree to use MailWand only for lawful purposes. You must not:

  • Use the service to process emails you do not have authority to access.
  • Attempt to reverse-engineer, decompile, or extract source code from the service.
  • Abuse API rate limits or interfere with the service's operation.
  • Use the service for any automated bulk processing, scraping, or data mining beyond normal personal or business email organization.

5. AI-Powered Features

  • MailWand uses OpenAI to classify emails and extract structured data. By using these features, you acknowledge that email content is processed by a third-party AI service.
  • AI classification and extraction results are provided on a best-effort basis. Results may be inaccurate, incomplete, or unexpected.
  • You are solely responsible for reviewing and acting on AI-generated classifications and extractions.

6. Email Actions

MailWand can perform actions on your actual mailbox, including archiving emails and marking them as read. These actions modify your email account directly and may not be reversible through MailWand. You are responsible for understanding the effect of any action you take within the service.

7. Intellectual Property

  • MailWand and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws.
  • You retain full ownership of your email data and any workspace configurations you create.
  • You grant MailWand a limited license to process your data as needed to provide the service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OF AI-POWERED CLASSIFICATIONS OR DATA EXTRACTIONS. WE ARE NOT RESPONSIBLE FOR MISSED, MISCLASSIFIED, OR INCORRECTLY PROCESSED EMAILS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILWAND AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY ERRORS, INACCURACIES, OR OMISSIONS IN AI-GENERATED CLASSIFICATIONS OR EXTRACTIONS; (D) ANY ACTION TAKEN ON YOUR MAILBOX THROUGH THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $0 IF THE SERVICE WAS PROVIDED FREE OF CHARGE.

10. Termination

  • You may stop using MailWand at any time by revoking OAuth access through your Google or Microsoft account settings.
  • We may suspend or terminate your access if you violate these terms or if we discontinue the service.
  • Upon termination, we will delete your server-side data in accordance with our Privacy Policy. Client-side cached data must be cleared through your browser.

11. Changes to Terms

We reserve the right to modify these terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of MailWand after changes constitutes acceptance of the revised terms.

12. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.

14. Eligibility

By using MailWand, you represent that you are at least 18 years of age. The service is not intended for children under 13, in compliance with the Children's Online Privacy Protection Act (COPPA).
